Infant Formula Milk Powder Sales Supervision and Management

On the 28th, the Guangdong Provincial Food and Drug Administration issued the “Administrative Measures on the Supervision and Administration of Infant Formula Milk Powder Sales (Draft for Comment)” (referred to as “Measures”)

The "Measures" proposes to prohibit enterprises from producing milk powder for infants and young children by entrusting, rebranding, or sub-packing. The same manufacturer cannot use the same formula to produce different brands, and requires companies to establish a traceability system for food sales.

The "Measures" stipulates that it is prohibited to sell milk powder for infants and young children that are produced from animal milk and dairy products other than cows, goat milk and milk powder, and dairy products, and it is prohibited to sell imported infant formula milk powder without a Chinese label. Operators should adopt information technology to establish a traceability system for food sales and an electronic ledger to achieve traceability of formula milk powder quality for infants and young children. In addition, the "Measures" stated that because of the probation officers who commit crimes related to "disposable oil," they must not apply for food circulation permits during the probation period. The "Measures" also require relevant departments to establish a comprehensive food safety credit file for infant formula milk powder operators. Those who meet the "black list" conditions for food safety shall be announced in time and be managed in accordance with the "black list."
